There's mounting speculation the tender process for the national broadband network is on the verge of collapse.
It's believed the Department of Communications is considering re-starting the tender process .. amid concerns about constitutional impediments to building the network.
The company that wins the rights to the project will need access to Telstra's existing infrastructure .. a proposition the telco is completely opposed to.
It's understood the department's also concerned the government may have to pay Telstra billions of dollars in compensation.
Opposition communications spokesman NICK MINCHIN says if the process is delayed beyond March .. it will be because of incompetence on the part of the government in the drafting of the tender documents.
